Andrew McCabe's counsel is pressing the Department of Justice (DOJ) on whether a grand jury has declined to bring charges against the former FBI deputy director, arguing such a move would cast doubt on the government's case against him.

Not only do they got nothing, but this also illuminates their trajectory and the ends to which they'll go to see it through.   If only the Dems were to spit out the gum and move quickly away from the kitchen table and directly into the "situation room".   There's not enough time in the day to contend with the shitshow that is upon us!

The Committee learned that the DNI was withholding from the Committee an authorized and protected whistleblower disclosure involving an “urgent concern,” which is defined by law as “a serious or flagrant problem, abuse, violation of law or Executive order, or deficiency relating to the funding, administration, or operation of an intelligence activity within the responsibility and authority of the Director of National Intelligence involving classified information.”

“Even though the disclosure was made by an individual within the Intelligence Community through lawful channels, you have improperly withheld that disclosure on the basis that, in your view, the complaint concerns conduct by someone outside of the Intelligence Community and because the complaint involves confidential and potentially privileged communications. In a further departure from the statute, your office consulted the Department of Justice about the complaint, even though the statute does not provide you discretion to review, appeal, reverse, or countermand in any way the IC IG’s independent determination, let alone to involve another entity within the Executive Branch in the handling of a whistleblower complaint. Your office, moreover, has refused to affirm or deny that officials or lawyers at the White House have been involved in your decision to withhold the complaint from the Committee. You have also refused to rule out to me that the urgent concern, and underlying conduct, relates to an area of active investigation by the Committee.

“The Committee can only conclude, based on this remarkable confluence of factors, that the serious misconduct at issue involves the President of the United States and/or other senior White House or Administration officials. This raises grave concerns that your office, together with the Department of Justice and possibly the White House, are engaged in an unlawful effort to protect the President and conceal from the Committee information related to his possible “serious or flagrant” misconduct, abuse of power, or violation of law.     

 

 

They have to create a branch of the FBI whose sole purpose is to investigate/spy on not only the current administration,  but also anyone running for president. That way when the whistle gets blown for treasonous acts or any wrongdoing, life long ethical honorable respected law enforcement officials won't get the screw put to em by a vindictive power drunk asshole, like clump

Barr can charge him even if he doesn’t have a grand jury indictment, it would more than likely play out very badly for the AG and the DOJ.

It might play out badly when viewed through a conventional lens;  however, in the world of alternate truth, isn't simply being charged "enough" to sustain the Trump narrative?

Maybe I haven't thought it through well enough, but it's not a bad idea.  Was actually considering the possibility that we might forever need a "persistent OSC watchdog for the President" in general terms ... but this would likely be an overreach.  Elections are more constrained and perhaps workable.

Can't help but wonder if this is in regard to an issue that would blow counterintelligence concerns wide open?  If so, "containment" is critical ... although will be extremely difficult ... as the cards are stacked against trying to reign in a rogue POTUS with a complicit Senate.

Congress is watchdog for the POTUS (in theory).

We're seeing how well that is playing out ... not sure what is best way forward other than to try and learn from mistakes and vulnerabilities.

Well that should not be be an overreach. WTF good is an FB of Investigation if it can't even investigate the criminal conduct of the most important office in the country, let alone world ? Brother Lassen brought a good point to light in another thread. Mueller did testify to congress about sadam's wmd's. What he testified to was Colin Powell told him sadam had em. Bob Mueller never saw any evidence himself. He was hamstrung, because it was not his job to investigate the claims of his president or sec of state or defense. I think its time that WAS the FBI's territory.
