As often happens, the cover up is worse the crime. If he had simply paid Stormy using a personal check with "hush money" on the memo line, that would have been perfectly legal. But he and Michael Cohen came up with a scheme to keep it under wraps by putting it down as "legal fees" on the books. They also used campaign funds. Therein lies the rub.
Campaign funds are strictly regulated and can't be used to pay hush money to porn stars. So there is one potential crime there, albeit a minor one. But falsification of the business records is also a crime under New York law and when the falsification of records is used to hide evidence of another crime (like campaign fund violations) it becomes a felony.
But again, I will believe it when I see it.

I think the crux of the case
I think the crux of the case is the hush money checks he wrote were claimed as legal expenses and as deductible expenses from his campaign. So it is a fraud charge I believe. They have the canceled checks with his signature and the memo stating legal services. I don't believe there is anything illegal with paying a porn star to keep quiet about a consensual sexual encounter, just don't claim it as anything else. Although paying to keep something like this quiet when you are campaigning for public office may be criminal even if you don't try and cover it up. The public does have a right to know who we are voting for. Although the George Santos fiasco makes me wonder. I guess he never paid anyone to try and cover up his lies so it might not be analogous to this Trump/Stormy Daniels affair.

Indictment is found based upon a preponderance of the evidence ("more likely than not"). This is standard is more similar to the one applied in civil law than criminal.
Criminal conviction is based on a jury's consideration of all the evidence and testimony combined to result in the accused being guilty beyond a reasonable doubt. (As his attorney and accountant already have been found, and served prison time for.)
(And not saying that I agree with the whole thing of how grand juries operate, just that they are part of the reality we live in.)
