Not a good sign when they're postponing a trial to conduct extended settlement conferences

Also not possible to know whether dominion is actually willing to settle. apparently this is taking place at the request of the judge (who probably thinks it should settle)

It's irritating (and abusive of the legal process in my opinion) for settlement discussions to continue after a jury has been selected

Ultimately, it is a business call by the parties.  Does it make financial sense to throw fate into the hands of 12 random people or accept a settlement that offers certainty and finality?   

DO NOT SETTLE.  Make Fox admit wrongdoing in court and apologize on air for LYING.  Then revoke their broadcast license.

Why the delay, is the judge pissed with all the deceit from the fox legal team or is there a settlement on the table. Fox is pretty exposed both with brand integrity and in dollars.

The bigger question here is where is the line in the sand when fox viewers finally get it, that they have been betrayed and played and lied to for profits.

The word(s) for the day is “pursuit of ratings” or financial gain over truth.

The brand will survive because the brand is built from a very forgiving and relatively impressionable and uncomplicated market sector. There is a value of belonging to a social group that has greater attraction than standing alone. Deniability and lack of desire for clarification or understanding will allow the brand to actually grow especially when truth is caged with zero challenge and alternate conspiracies are repeated until they too are accepted as true and undisputed.

What is your plan when you hear your tv hero address the court or worse plead the 5th that they intentionally lied to you, deceived you, misinformed you for higher corp ratings and higher profit…

Deniability will be the default for most. Does deniability make it true. And if it is not true, what is the basis or rational foundation for continuing to support and believe such.

With most accepting the disputed claims without dispute, what is your new position - do you continue to defend known lies, or step back and allow the known facts spoken from the same mouth as the original lies were sourced change your opinion.

Question everything…

No matter how you slice it $1.6 billion is a big number. 

I think this will go to trial, Fox won't give Dominion what they want in a settlement and Dominion has the upper hand here.

Whatever they pay Dominion they will also have to pay to the other voter machine company that is also suing them.

Most people who watch Fox News don't watch anything else and are unaware of the lawsuit.  Fox News doesn't report on it at all and even if one of their regular viewers heard about it from another source, they would likely dismiss it as "fake news" or an attempt by the deep state to silence the network.   Even if it goes to trial and it loses, Fox News will not mention it and continue instead to provide what its viewers want - a daily dose of confirmation bias for frightened old white people.

I'll take that bet. $787.5 million, and Fox' acknowledgment of the Court's ruling on their wrongdoing Zang quoted above.

And people who watch Fox News will never hear of the lawsuit, the settlement, or admission of wrongdoing.

Weak sauce.  No real apology, and they got less than 1/2 of what they were asking.

If it went to trial, the award would have been decided by the jury. The amount would be very unpredictable, and that's if Dominion won.

Then there's the appeal. Fox would have definitely appealed, and that could drag on for a long, long time. And Fox could win an appeal.

Dominion's lawyers did what any smart lawyers would have done, they held out to the last minute, and walked out the door with $787.5 mil.

Yes, I would have loved to see a trial too, but would you turn down that kind of money just to put on a show?

On principle, maybe yes, but odds are you would live to regret it.

^^^^I often explain to clients that the only people who come out ahead taking a case to trial are the lawyers and expert witnesses.

The settlement sucks. 

Rupert Murdoch is protected by this. He didn’t have to take the witness stand. That sucks. The Fox institution has been protected. They have not been proven guilty. This settlement will have no impact on Fox’s audience, or their ratings, whatsoever. Murdoch did not have to testify under oath. That sucks. 

It’s not a victory. Dominion got some money, but it’s not a victory for us. It’s a failure. 

The only people who don't know about this are the ones who basically only watch Fox anyways 

Did you expect some big loss at a trial at some court in Delaware would finally bring the Fox watchers around? How much of a loss would that take? What's the number?  That was an unrealistic expectation to begin with.

Would a trial be cathartic? Entertaining? Yes, probably for those in the room. The rest of us can't watch or listen anyways. But the trial unfortunately isn't the primary goal, it just another (main) stop along the legal road. The realistic goal is to chip away the stone. And to make as big a chip as possible while balancing this against the least risk and cost possible to yourself along the way.

I think dominion has done that correctly. You were never getting an apology from Fox regardless who won or lost or what salacious truths were revealed at trial. Fox was never in danger of going "off the air". Nobody was getting fired, tarred and feathered, or going to jail. That's not part of the civil court process. The only thing that exists at the end of this road is an arbitrary dollar amount, for or against. That's the only ending there is. In the current reality of our court system, a guaranteed $787 million is a win.
