Busted in Ohio

Forums:

Anyone know the laws in Ohio? I had a friend who was just pulled over with more than 100lbs of weed. Assuming he's fucked?

i visited a pot farm in ohio back in the day.

mama was preggers puffin' doobies in a rocking chair.

they had 6+ trails going from the cabin with a pitbull chained to the top of each trail.

guy thought i was a narc.

Major bummer.

Ohio Rev. Stat. § 13.657(a):   “Anyone found to be in possession of 100 lbs or more of Marihuana is fucked.”

I hear about people from the West Coast getting busted all the time headed east with U-Haul loads of ganja in places like Nebraska and Idaho.   Be careful folks.

>>> “Anyone found to be in possession of 100 lbs or more of Marihuana is fucked.”

About right.

>>I hear about people from the West Coast getting busted all the time headed east with U-Haul loads of ganja in places like Nebraska and Idaho.

When we were driving to Furthur Festival in 2010 from Rhode Island we got pulled over in Iowa by a tobacco-chewing state trooper who kept spitting as some sort of intimidation strategy.  We just kept stating we had no weed and he suspected we were drug mules going across country.  Our trunk was legitimately packed to max capacity and, after a while, we were like "Sure, fuck it- knock yourself out.  Look in our trunk".  Guy opened the trunk and was pretty much like "Fuck this- get out of here".

As for OP, I suspect your friend is fucked.  Probably not as fucked as times past but 100 lbs of reefer is a 100 lbs of reefer.

Thanks, guys. Probably not the best idea to have dreads and a beard driving a Uhaul full of weed through the Midwest.... I can see this in your 20's but late 30's. WTF?

Sounds like your friend is in trouble lest he can challenge the validity of the stop.

In Ohio, it is a crime to intentionally or knowingly possess marijuana (except for persons authorized to possess medical marijuana). Like many other states, the penalties for possessing marijuana (sale, cultivation or possession of paraphernalia are not discussed in this article) depend on the amount of the drug possessed. Generally, possession penalties are as follows:

Up to 100 grams: The Ohio legislature has decriminalized the possession of small amounts of marijuana. Violations in this range are minor misdemeanors, meaning that there is no jail time involved and convictions are not included on a person’s a criminal record. However, violators may be fined up to $150.

100 to 200 grams: Possession of marijuana in this weight range carries a misdemeanor charge with fines up to $250 and up to 30 days of incarceration.

200 to 1,000 grams: Possession of this amount and above is a felony charge. Violators face fines of up to $2,500 and 1 year in jail.

1,000 to 20,000 grams: Penalties include fines of between $5,000 and $10,000 and up to five years in prison.

20,000 to 40,000 grams: Penalties include a minimum of five years in prison (maximum of eight years) and between $7,500 and $15,000 in fines.

40,000 grams or more: Violators may be fined between $10,000 and $20,000 and incarceration for a minimum of eight years.

In addition to the above penalties, persons convicted of possessing more than 100 grams of marijuana face suspension of their drivers’ licenses for up to five years (minimum of six months).

Marijuana Possession

Possession of marijuana is a crime in the state of Ohio. There are two types of marijuana possession — actual possession and constructive possession — that can lead to a criminal conviction. Physical possession occurs when marijuana is found on your person, either in your pockets or in a bag you’re carrying. In cases of constructive possession, marijuana is found and linked back to you: either because it was found on your property, or because you were determined to be the principle possessor of the substance. The severity of marijuana possession charges are typically determined by the amount of marijuana found. Learn more in the short guide below:

Less than 100 grams: Minor misdemeanor punishable by a fine of up to $150.

100-200 grams: 4 th degree misdemeanor punishable by 30 days in jail; $250 fine.

200-1,000 grams: 5 th degree felony punishable by 6 months to 1 year in prison; community control presumed.

1,000-5,000 grams: 3 rd degree felony punishable by 9 months to 3 years in prison; no presumption of prison.

5,000-20,000 grams: 3 rd degree felony punishable by 9 months to 3 years in prison; prison time presumed.

20,000-40,000 grams: 2 nd degree felony punishable by 5-8 years in prison (mandatory).

More than 40,000 grams: 2 nd degree felony punishable by a mandatory 8 years in prison.

Marijuana Trafficking

The state of Ohio defines marijuana trafficking as selling, offering, or packaging marijuana. Depending on the amount of marijuana discovered, marijuana trafficking may be a felony ranging from a felony of the 1 st degree (most severe) to a felony of the 5 th degree (least severe). See the breakdown for more information.

≤20 grams: Minor misdemeanor, $150 fine

>20 grams – <200 grams: 5th degree felony; presumption for community control

200 grams – <1 kg: 4th degree felony; presumption for community control

1 kg – <5 kg: 3rd degree felony, presumption for community control and prison time (9 months – 3 years)

5 kg – <20 kg: 3rd degree felony, presumption in favor of prison time (9 months – 3 years)

20 kg – <40 kg: 2nd degree felony, prison time mandatory (5-8 years)

≥40 kg: 1st degree felony, prison time mandatory (mandatory 8 years)

100 lbs = 45,359 grams.   Ouch.

A long time ago in Ohio you could have about 3 oz and it was not a huge deal, 100 lbs. He better hope they fucked something up in the process of arresting him

Turtle was that farm in Athens, Oh?

The Athens growers have been on the forefront of advances in growing herbs

my wv buddies were connected with athens people.

who is that pic java? sideshow and fid?

Why didn't he throw it out the window?

Not sure what you're implying Java Dave -I'll just assume it's your version of a passive aggressive burn.

Pretty sure that picture is of two parents in Ohio that nodded off in their car while their kid was in the back. The kid did not partake in the heroin, which is why he is awake.

Why didn't he eat it?

Pretty common knowledge these days that all long-haul west coast to east coast marijuana smuggling routes go through Canada, which is a safe-haven for smugglers and users too.

Lol.

Ahh Colorado...........think I'll just stay here.
