US House Speaker Johnson says Congress can 'eliminate' district courts

 

"It violates separation of powers when a judge thinks that they can enjoin something that a president is doing, that the American people voted for," Johnson said during his weekly press conference.

He said the House Judiciary Committee plans to hold a hearing next week "to highlight these abuses" and had recently advanced legislation that would prevent district court judges from issuing nationwide injunctions blocking policies.

"We do have authority over the federal courts," he said. "As you know, we can eliminate an entire district court. We have power over funding, over the courts and all these other things. But desperate times call for desperate measures, and Congress is going to act."

Article III, Sec. 1 states:  "The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish."   So yes, Congress has the technical ability to abolish the US District Courts.   But as a practical matter, it won't happen.  The US District Courts are already overworked and under staffed and you need courts to function as a society.  It's just a plain stupid idea and they would never get a majority of the House and certainly not 60% of the Senate to go along with such a dumb plan.

 

Why do you believe they couldn't get a majority in the House? 

It is possible as long as Republican control the house and tge Senate. The filibuster would be eliminated if they could push it through the House. 

 

Courts are unnecessary for an Authoritarian government. 

 

 

The Republicans have only a very slim majority in the House and trying to abolish a District Court will be so chaotic and disruptive that it would be a bridge to far for enough of them and the measure to fail.  I can see the kooks like MTG and Boebert doing it for show, but enough of the rest will know that they will never get 60% of the Senate to go along and attempting something so plain stupid would be a fool's errand that will cost them in the midterms.  The Senate won't abolish the filibuster for this nonsense.

The American electorate needs a  refresher course in Civics...

In the meantime, Trump is trying to redefine the American electorate.

President Trump signed an executive order on Tuesday that will require proof of U.S. citizenship on election forms, in an aggressive push to catch and combat voter fraud, which is exceedingly rare but constantly cited by Mr. Trump as a reason he lost the 2020 election.

The order calls for the Election Assistance Commission to require people to show government-issued proof of U.S. citizenship to register to vote in federal elections, and directs state or local officials to record and verify the information. It also seeks to require states to count ballots by Election Day.
