Nunes would have to be approved by the Senate. At least I heard if Trump wants to avoid a Senate confirmation he’d have to appoint someone in the cabinet that has already been confirmed by the Senate.
Mueller has left parts of the russian investigation in different courts around the country so even if his investigation is shut down some court cases will proceed in South District of New York, Cohen in Manhattan district court and Northern Virginia cases all still go forward without Mueller & Rosenstein.
So my guess is that Trump ordered John Kelly to fire Rosenstein - he shows up and Kelly asks for his resignation. Rosenstein says no. Kelly isn’t willing to fire him. Trump will return on Thursday and fire them both
