The founders clearly established a principle of legislative supremacy as the primary underpinning of the architecture of the Constitution.
The Constitution clearly enumerates "the Senate shall have the sole Power to try all Impeachments".
On Feb 9, the Senate exercised its power with a bipartisan majority vote to affirm its Constitutional jurisdiction in a trial of a former President.
Today, Senator Mitch McConnell explained his vote to acquit Trump in the impeachment trial was due to his belief the Senate does not have the jurisdiction to conduct an impeachment trial of a former President after leaving office.
Was the Senate vote on Feb 9 non-binding and Senator McConnell (and other Senators) simply believed they were able to override it? If this is the case, can Senators simply ignore any vote they disagree with?
Seems to me that the Senators should have voted based on the merits of the case. If Trump was then found guilty, then his lawyers could have appealed the Constitutionality to the SCOTUS. McConnell and other Republicans clearly think he was guilty as charged.

I agree with your main underlying sentiment, but not sure how an appeal of the Constitutionality to the SCOTUS on an impeachment would work if it's a clear separate of powers issue? IOW, if the Constitution clearly states "the Senate shall have the sole Power to try all Impeachments", and the Constitution is otherwise silent on the timing, then would the SCOTUS be overstepping it's bounds other than to simply concur with what is written in the Constitution?
This morning our Republic awakens in a greatly reduced state. The only question now is whether this trend will continue, or reverse?<<<
I'm convinced it's a slippery slope / downward spiral from here on out ... unless there's some major step to assert accountability (i.e. 14th or new impeachment trial).
There is no appeal to the Supreme Court or any other court.
The Senate makes its own rules for this.
It is a political decision.
Mitch was disingenuous when he voted to acquit a guilty man on the grounds that the Senate had no jurisdiction. The Senate decided this issue by a vote at the start of the proceedings and found there was jurisdiction.
At the end of the day, all the democrats want is a one party system and what's worse is the one global government aspirations in the name of defeating climate change. Lawmakers Consider 2 Plans For Monthly Payments To Address Child Poverty
The new COVID-19 relief bill includes proposals that were unthinkable not that long ago: giving families a few hundred dollars every month, for every child in their household
Since Biden is not a dictator and cannot order Manchin to vote for it, they could earmark some money for West Virginia, that might persuade Manchin. Biden could threaten to support a primary challenger next time Manchin is up for election in 2024. But that's not much of a threat, Biden only received 29.69%, in West Virginia. Schumer could threaten to take away Manchin's committee assignment.
If Biden/Schumer plays hard ball, Manchin could threaten to withhold support for much, or all ,of Biden's agenda, This would mean that not much of anything would pass.
And although he has previously stated he wouldn't, Manchin could switch parties. That seems like a severe consequence to me.
The House bill looks pretty comprehensive, by far the best stimulus package to date. I'd hate to see a $15 minimum wage hold it up, when other Covid benefits are set to end in a month.
> your party is doing exactly what you want them to <
Incorrect.
>if biden cared, he get manchin on board<
How? You said there would be consequences, please explain what sort or consequences. I'm seriously interested in what you believe Biden can do.
>dictator. lol. how many times have you posted that word on viva<
Likely everytime you insist that Biden can impose his will and order legislators to vote a particular way.
>you're over thinking this<
You said there could be severe consequences, I just suggest a few realistic scenarios. Conversly, you make unsupported claims of Biden's leverage over Manchin. What can Biden do? Please explain.
>The House bill looks pretty comprehensive... I'd hate to see a $15 minimum wage hold it up, when other Covid benefits are set to end in a month.<
biden can use his power as president of the united states to get manchin to support the package. he doesn't need to personally support the $15 min wage. he must vote for the package.
this happens all the time. you know this.
dem leadership, biden, the fucking president, uses his office to get manchin on board.
The minimum wage needs its own bill that can be debated. That way the voters can see, front and center, the douchebags that are content to keep the $7.25 wage (or whatever poverty level shit many of them will try to get through). Tying it in to Covid relief won't work.
>biden can use his power as president of the united states to get manchin to support the package<
Which presidential power would that be? Please explain.
Apparently, the $15 is a deal breaker for Manchin and Sinema.
>$15min wage (which is already laughable)<
I agree. I was listening to a business owner pine over his inability to hire new employees, despite offering $16 per hour. I shook my head and said, "maybe it's because people can't support a family with $16 per hour."
if you don't understand how the president can use their influence and power of the office to get shitheads from their party on board, then go take a class like you tell me.
^Games? You said Biden can "use his power as president of the united states "
Which presidential power?
>if you don't understand how the president can use their influence and power of the office to get shitheads from their party on board, then go take a class like you tell me. <
I do understand, this is why I suggested a few possible scenarios, refuting your unsubstantiated claims.
holding a vote on m4a is dismantling the entire system? well, maybe in a way -- but not the way you're implying it.
<<<>>>The minimum wage needs its own bill that can be debated. That way the voters can see, front and center, the douchebags that are content to keep the $7.25 wage (or whatever poverty level shit many of them will try to get through). Tying it in to Covid relief won't work.
yes, in fact, exactly the same. haha. what are you talking about?
Well, like it or not, universal health simply won't pass until there are more Progressives in Congress. An increase to minimum wage can and will. I don't see it being $15, but 10 or 12 is better than $7.25.
Like it or not, universal health is dismantling a multi billion dollar system with a lot of political power behind it, the cocks of which politicians must suck. It's a very big change that will have ripple effects.
That's just fact. I want to see it happen, but those are the major obstacles.
If you show me where I was against a symbolic m4a vote within the last month (or ever), I'll drive to Burlington, purchase and eat an entire one of your pizzas this evening.
>>we have to flush out the scum, take a vote, force opponents of this basic human right to show themselves.
Minimum wage increase isn't that much of a politicized issue, and having a vote now will do exactly that. Although I wish it would, I don't see it happening with universal health, at least not right now.
$15 minimum wage and the need for universal healthcare are inextricably linked.
Why?
because the job that pays people nine bucks an hour is the same one that takes a third of it to pay for "healthcare" that can't even buy a bandaid without a copay.
For the sake of playing devil's advocate, I'll say that's not exactly true, Bss. The thresholds for free and subsidized health can easily go up commensurate with an increase in minimum wage, so that the only winner isn't the insurance industry.
The states that chose to be on the Federal Exchange are locked into the numbers set by the feds. Vermont, for instance, has a considerably higher threshold. I think that a few shithole red states have lower thresholds.
I only bring this up because if they are inextricably linked, then we're fucked. By unlinking them, at least it's a stopgap measure that can allow for some progress, and not put billions more into the pockets of the health insurance industry.
Sanders confident of raising minimum wage as part of $1.9tn Covid package
Bernie Sanders said on Saturday he was confident Senate Democrats will be able to raise the US minimum wage to $15, a step firmly opposed by Republicans but a key part of the Biden administration’s $1.9tn coronavirus relief package.
In a statement, the Vermont independent who caucuses with Democrats and chairs the Senate budget committee said he was “very proud of the strong arguments our legal team is making to the parliamentarian that raising the minimum wage to $15 an hour is not ‘incidental’ to the federal budget and is permissible under the rules of reconciliation”.
Reconciliation allows legislators to bypass the 60-vote majority needed for most Senate legislation, for items linked to spending and taxation. When Donald Trump held the White House, Republicans used it to force through tax cuts. Under Barack Obama, Democrats used it to help pass the Affordable Care Act.
Sanders is championing moves to more than double the federal minimum wage from $7.25 an hour, its level since 2009, over a five-year period. The move is a key part of the Biden coronavirus relief package, meant to tackle the devastating impact of a pandemic in which nearly 500,000 have died and unemployment has rocketed.
“Half of our workers are living paycheck to paycheck and millions of people are working for starvation wages,” Sanders wrote on Twitter on Friday. “We need the minimum wage to be a living wage and that’s why we’re going to raise it to $15 an hour.”
Public opinion is heavily in favour of the rise but Republicans are ranged against it, arguing that it would damage small businesses. Sanders counters that the gradual rise over five years should allay such concerns.
The Vermont senator is an experienced operator. After a coordinated if symbolic Republican move against the wage rise earlier this month, one Sanders staffer said: “This isn’t Bernie’s first rodeo … we can still try to pass minimum wage through the reconciliation bill.”
In his statement on Saturday, Sanders referred to two Republican priorities under Trump which could not reach 60 votes but which were pursued through reconciliation.
“The [Congressional Budget Office] has found that the $15 minimum wage has a much greater impact on the federal budget than opening up the Arctic national wildlife refuge to oil drilling and repealing the [ACA] individual mandate penalties,” he said, “two provisions that the parliamentarian advised did not violate the Byrd rule when Republicans controlled the Senate.”
The Byrd rule is named for Robert Byrd, a long-serving Democratic senator from West Virginia who died in 2010. According to the non-partisan Center on Budget and Policy Priorities, or CBPP, it “allows senators to block provisions of reconciliation bills that are ‘extraneous’ to reconciliation’s basic purpose of implementing budget changes”.
The Senate parliamentarian, Elizabeth MacDonough, is the first woman to interpret and manage the rules of Senate procedure. She must decide if a minimum wage raise can be pursued through reconciliation.
On Saturday, Sanders said he was confident McDonough would do so next week.
>>>For the sake of playing devil's advocate, I'll say that's not exactly true, Bss. The thresholds for free and subsidized health can easily go up commensurate with an increase in minimum wage, so that the only winner isn't the insurance industry<<
Sure they can. Just like they can also go down. That legislators rely on incremental tweaks like fine-tuning entry thresholds and wage minimums to avoid the obvious, however; (That we don't even have a basic public option in this country) is an affirmation that we are operating in more or less full deferment to insurance operators. (Who also quite obviously have a fiduciary responsibility to return maximum profits to their shareholders).
So while its not exactly true, it's generally true, and more importantly it's functionally true.
maximum profit and maximum civic health just flat out aren't symbiotic goals.
Advocates for $15 wage urge US Sen. Joe Manchin not to compromise on issue
Advocates for a $15 minimum wage said Thursday that Democratic U.S. Sen. Joe Manchin told them he was more open to a compromise that would raise the federal standard to $11
>lumber, covid relief needs to have been passed weeks ago by the dems -- so i think that needs to be passed right now, today. immediately<
I agree. unfortunately, reconciliation is not an instantaneous process. It requires weeks. This is one of the reasons Biden was looking for some Republican support. Hell, the Senate parliamentarian hasn't even ruled as to if the $15 minimum wage can be included, as per the rules of reconciliation.
>then there should be a bill making the min wage $20/hr. <
Biden has stated a similar opinion, although it was for the current $15 target. A $20 bill is likely DOA. Half a loaf.
Pro tip on green tea: whether in teabags or loose leaf, as long as you don't use boiling water you can get 3 brewings out of your tea leaves. I believe that the 3rd brewing is actually the strongest.
The errors to green tea are using too hot water and releasing tannins, as well as over-steeping.
I only use the highest quality green teas I can find. Used to have a loose leaf green tea supplier but her store flooded. I have an electric kettle which I set to 200 (or what is says on the box). I wish that lady was still around. She had so many different phenomenal varieties. Still looking for another vendor like her.

True, almost all under Title 42, which is meant to stop the spread of Rona. It tends to target people from non White countries and needs to be ended.
By all counts, almost all of the deportations have been new arrivals. ICE is no longer allowed to deport people who have been here for a while, without senior management approval.
Biden tried to stop all deportations, but a federal judge in TX, appointed by Trump, shot it down.
These are not corporate apologist talking points, they are facts that give context to your statement.
Seriously, they should toss the filibuster. Sure, that could come around and bite them in the ass at some future date, but it's totally undemocratic and has to go.
Toomey's seat is up in 2022, a Democrat winning that seat could help. 34 senate seats up in 2022... 14 currently held by a Democrat, 20 by a Republican.

>the dems lowered the stimulus from the promised $2K to $1400 in the name of bipartisanship<
No, they lowered it because of math. $600(last relief bill passed under Trump) plus $1400( current bill) equals $2000, or...
600+1400=2000
What is Biden's leverage? Will he threaten not to endorse Manchin next time? After all Biden did carry 29% of the vote in West Virginia. Could try to play hardball and guarantee a difficult road for all future legislation, 50/50 split and all.
Not only is Manchin opposed to the $15, but he will not vote to overrule the Senate Parliamentarian.
Sure, they could try to include it and delay the legislation even longer.
The Democrats wanted $2000, they were able to pass $600 while Trump was in office. The balance is $1400. $600+$1400... That's $2000, regardless of your opinion.
>damn dude. i thought you were better than that<
Give me a more difficult math problem and maybe I'll exceed your expectations.
I'd like to point out that it took 9 months to pass the 2nd stimulus, which totally sucked. In far less than half the time they are going to pass a $1.4 trillion relief act, the largest and most sweeping in history.
It's pretty telling that people are complaining that it's not big enough, fast enough, or that it doesn't have all the things that people want. Sometimes I think that people are just looking for shit to complain about. In this case, when it passes, credit should be given.
The GOP gets stuff done because they're lying sacks of shit who cheat and have absolutely no principles. You want the Dems to go that way? Is that what you're saying, ogkb?
> this isn't even up for debate.
Post a link, and then I'll believe you. Go ahead and Google it, Broken Bernie Bro.
$1,400 would still be the biggest check to date. Are you complaining? And, lol at you actually expecting a campaign promise to be kept to a T. Pro tip: they all make bullshit promises that anyone with half a brain knows can't be kept (don't tell anyone, but Bernie's campaign promises were just ridiculous and never could have become reality).
No, Pyramid, what I'm saying is that these things require votes, votes that aren't there. The $15 was initially in, and Biden supported it. Unfortunately, Sinema and Manchin balked. Manchin said maybe $11? So how much longer should they negotiate to find a number, less than $15, that Manchin and Sinema would support?
Regarding the elimination of the filibuster... Manchin is against it. That's a vote that would lose him his seat, and he doesn't want that to happen. Sure, he'll hide behind some empty rhetoric about respecting the rules and traditions of the Senate. But in the end, the democrats need a majority which makes Manchin irrelevant.
I'm happy to keep you entertained, since you don't seem receptive to being educated, or showing any class. Stick with parroting your worn out, ill-considered talking points and name-calling though. They seem to make you happy.
Holy fuck, put down the weed. Manchin represents the people of his state, who overwhelmingly don't support all those good things. As he's elected (and re-elected) by them, he's not going to back a controversial bill that his constituents don't want.
What exactly don't you understand about the basic concept of representative government?
Meghan McCain complained on “The View” on Friday that pointed criticism from President Joe Biden is leading to more tribalism and making Republicans think “we’re just deplorable Neanderthals.”
Biden on Wednesday criticized some GOP governors’ decisions to end mask mandates as “Neanderthal thinking” that would set the nation back in its battle against COVID-19. The comment struck a nerve with apparent Neanderthal defenders, including Sen. Marsha Blackburn (R-Tenn.), who characterized the homonids as a family-values species. Neanderthals are also famously extinct.
During their show on Friday, the co-hosts of “The View” weighed in. Joy Behar quipped that Biden’s comment may have been a ruse to get Republicans to admit evolution exists. Sunny Hostin slammed the faux outrage as “pearl clutching” — particularly in light of former President Donald Trump’s relentless, appalling insults “debasing and degrading people.”

What sort of consequences were you thinking?

Just a thought...

True, almost all under Title 42, which is meant to stop the spread of Rona. It tends to target people from non White countries and needs to be ended.
By all counts, almost all of the deportations have been new arrivals. ICE is no longer allowed to deport people who have been here for a while, without senior management approval.

It passed the house. Now all 50 Democratic senators must vote for it, for Senate approval.
